Terms and Conditions
These Terms and Conditions govern the use of the cap hpi website (the “Site”) and the purchase and use of cap hpi online reports (the “Reports”). The Site and the Reports herein is owned by cap hpi Ltd, a company registered in England and Wales with registered number 08033745 and whose registered office is Capitol House, Bond Court, Leeds LS1 5EZ (“cap hpi”).
"we"/ "us"/ "ours" means or refers to cap hpi Ltd, a company registered in England and Wales with registered number 08033745 and whose registered office is Capitol House, Bond Court, Leeds LS1 5EZ (“cap hpi”)
"you"/ "your" means or refers to you, the customer, who purchases and receives the Report subject to these Terms and Conditions.
By using this Site to purchase Reports you agree to be legally bound by these Terms and Conditions which shall take effect when a Report is purchased.
cap hpi may change these Terms and Conditions at any time by posting changes online. Please review these Terms and Conditions regularly to ensure you are aware of any changes made. Your continued use of this Site and purchase of Reports after changes are posted means you agree to be legally bound by these Terms and Conditions as updated and/or amended.
Intellectual Property and Copyright
No intellectual property right, copyright, or any other rights in or in connection with any material, including but not limited to names, images, pictures, logos, text, and icons contained in the Reports (the “Content”) shall transfer to you and such rights shall remain vested in cap hpi absolutely and unconditionally at all times. Your use of the Content is strictly subject to these Terms and Conditions. You may view the Content solely for your lawful, personal or internal business use. Any other use is strictly prohibited save as permitted by law.
In particular, you may not do any of the following:
- a) Reproduce, modify or in any way commercially exploit any of the Content
- b) Redistribute any of the Content
You agree to hold us harmless and indemnify us against all costs, expenses, losses, or damages we suffer, however arising, as a result of or in connection with your misuse and abuse of the Reports and Content.
Use of your Personal Data
To the extent personal data is collected and obtained from you, you agree and consent to us storing and processing such personal data and relevant information about you for the sole purposes of administering the purchase of the Reports and providing any related customer service.
By submitting an order on the cap hpi Ltd online store, you (the “Customer”) agree that these Terms and Conditions for supply of cap hpi Reports govern the ordering and use of these Reports offered by cap hpi ltd.
By pre-ordering or ordering these Reports online, by phone or by email, and when the Reports are downloaded, streamed or digitally transferred to you, you acknowledge and agree that you shall lose your 14 day right to cancel under the Consumer Contracts Regulations 2013.
Warranty and Exclusion of Liability
We make no warranties or representations as to the accuracy of the Reports and Content contained herein; all Reports and Content are provided AS IS. You or any other person should not make commercial decisions based solely on the Reports and Content and you shall bear all risks associated with the use of and reliance made upon the Reports and Content.
You will not hold us responsible or liable for any and all damages and losses, consequential or otherwise, direct or indirect, however arising out of or in connection with the use of the Report and waive all right to such claims whether based on contract, tort, or otherwise.
We do not limit or exclude our liability for death or personal injury arising from our negligence or that of our servants or agents.
Except as expressly provided in these Terms and Conditions, all other conditions, terms, and warranties, express or implied by statute or otherwise are excluded to the fullest extent permitted by law.
Each provision in this section is to be construed as a separate limitation applying and surviving even if for any reason one or the other of the said provisions is held inapplicable or unreasonable in any circumstances, and shall remain in force notwithstanding the performance of the agreement.
Fees and Payments.
VAT will be applied on all orders at the applicable rate based on the customer's location and on the assumption that the customer is a consumer for VAT purposes. cap hpi ltd VAT No: GB133 299 705. Reports will be charged at the currency selected by the Customer at checkout. The fee for the Report will be stated at the time of purchase and all orders are payable in advance.
You acknowledge and agree that cap hpi uses the secure online payment processing service delivered by Stripe, Inc. (“Stripe”), and all financial and personal data you provide as part of the payment process is supplied to, controlled, and processed by Stripe and that we do not collect nor process any financial or such related personal data of yours. Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry.
All receipts, invoices and delivery of the Reports will use the details provided by the customer.
cap hpi has the right to decline any transaction.
